Ah, another instance of the good old "it's not sexual assault if it's a woman doing it!!" It's made worse considering Stabler is married, and also Babs and Stabler were not on good terms.
According to the wiki, Benson and Babs actually did kiss in an unedited scene, but NBC axed it.

I found the end interesting, where Babs kisses Elliot. If a Male was to just do that out of the blue to a female he would not only get slapped but might also be up on not just assault but probably sexual assault. In Babs case it also could have been assaulting an officer.
