Good Question! When there is a vacancy in the office of Vice President, both houses of Congress must approve the replacement. This is according to the 25th Amendment, and has happened twice previously: Gerald Ford and Nelson Rockefeller. The Senate alone picks the VP when no candidate earns a majority in the Electoral College.

Good episode. My only question is why does the House of Representatives have anything to do with confirming the VP? I understand that nearly the entire government was wiped out, but Constitutionally the Senate confirms appointments. In the event of electoral college deadlock, the Senate elects the VP. It seems unlikely that they would just decide to have the House do it instead, when normally it would have nothing to do with it. Didn't they already replace the Senate anyway?

Was this a mistake by the writers? It seems unlikely seeing as they seem to have followed pretty closely thus far what would actually happen under the Constitution and federal law. But if it's not a mistake, what's the rationale for having the House confirm the VP?

The one thing that I always get annoyed with this type of conspiracy shows is the repetive nature of letting the bad guys win althought it seems the good guys are getting to them. I understand now why some shows are down to shorter seasons.
